Texas' new mandatory evacuation enforcement law is wrong

I'm a little late in responding I know but I wanted to say that I completely agreed with your assessment of the mandatory evacuation enforcement law that is about to go into effect Sept 1.

I know we are a "law and order" state and we always talk about "Justice - Texas Style" but for a long time I've felt things have gone over board somewhat in regards to police power. Here is a very short example:

(I wish I could find this link) In a Houston (or San Anton?) restaurant, that has an outside patio in front of their place where people can eat outside on nice days there were some kids riding skateboards in front of the restaurant and were asked to leave by a customer (skateboards being banned by city ordinance). The youth refused and made a small ruckus and the Police were called.
Now here is the kicker: The police arrive and told the youth to leave AND to "calm" the ruckus the police told the owner to close his patio for the day. The owner states "I'm not breaking the law, the skateboard riders are in offense of the law." The police officer said (I'm paraphrasing of course) "Close your outside patio anyway. This is a lawful order. I am directing you to do as ordered."   --- The owner does not. The police officer later comes back and arrests the owner charging him for "Not following lawful legal orders by a peace officer."

This is too much police power. A vast majority of conservative Texans will applaud this exercise of "justice" and so will the officer's capt.
and police chief. As a Texas Conservative, I find it wrong. (On many levels.)

If this happened, it is doubtful that the officer issued a lawful order. Remember I had a Lubbock police officer tell me, in writing, not to comply with city code and not to bother a person who was breaking the code. Frankly, as in any group, there are a few in uniform who aren't so bright - a few of them even get promoted to public information officer positions too!
