Pratt,

I am sending this to you and every person who shows up on my email list and to any news outlet and area school district and maybe any place I see that has an email. That is just step one. I am furious.

This is regarding a background check company in Dallas that does background checks for public schools and other businesses. Lubbock Public Schools uses this company to prescreen potential teachers. I have been applying to LISD for years and never had a call. NOW I may know why.

The company is:

[Name has been removed, it's good enough to say it is a firm used by Lubbock ISD]

Keep in mind this company gets paid each time they do this "research." They have had three inquiries on me this month.

On my own initiative I called the background check company that Lubbock Schools uses and asked for a copy of the criminal search information regarding their report on me. Something just didn't seem right and I was investigating. They told me that it would require me filling out some forms and proving my identity to see what they are reporting.

BUT the man I spoke to this morning by phone said... I'll just save you the trouble and tell you it is about your SEXUAL OFFENDER CHARGE from when you lived in Pennsylvania.

I explained to him as I yelled that there are two problems with that.  The small one is I never ever lived in Pennsylvania and the second issue I have against his report is I have never been suspected, accused, charged, convicted or guilty of a sexual offense anywhere at any time.  It is NOT me.

The man's answer shocked me.

He said..."well someone with the same last name and first name as you, who was born the same year as you IS a sexual offender. "
That was his explanation!

To him that cleared his company of any fault. He said that is a match in their books and he has to report it. I couldn't believe it!

This employee of the firm assured me that IF I could prove it is an error then he can get it all cleared up but he said since 2008 the rules are so strict on background checks that if there are any same names and same birth years they must be reported as a possible security risk.
He claims any background check company would have done the same thing.

Did I mention I am not guilty of this?

This "requirement" sounds just stupid enough to be true but I still don't believe it. I have been interviewing with great companies, and had some incredible first and second interviews and I never get called back after the background check. Remember this company says they have had THREE INQUIRIES about me just this December!

There are three men in this town alone with the same first and last name as mine. When I lived in the small town of Kilgore TX there was a person with the same first and last name as me.

He wrote hot checks.

There are several names that match mine the Austin area.

There are dozens who have my first and last name who are ham radio operators like me. Dozens with the same name who are teachers.
I am sure some of them were born in 1954.

Who knows how many in the whole country match my name and birth year? Certainly the "background check industry" doesn't know. I found 50 names that match mine on www.criminalsearches.com alone.  They are not me.

I guess I wanted to just let people know.

What if I had never checked? Is there any entity that checks what background check companies report? How do you know you as an employer are getting accurate info when you pay for that?

What controls and checks are there on our information technology as far as a constitutional right to face your accuser?

We better get a hold on this technology or anyone can be "profiled" and falsely accused and never know it. Think about it.

You need to know this stupidity exists, the risk to your reputation, the possibility that someone you are hiring may NOT be guilty of whatever shows in their background check and you need to know LISD is not getting their money's worth with your tax dollars. (big shock huh!)

Thanks,
R. K. - a person with a shared name
